Terms & Conditions

1. GENERAL

1.1 These Terms & Conditions ("Terms") apply to all bookings made with ACM Elite Events, operated by Alan Moores as a sole trader ("ACM Elite Events", "we", "us" or "our").

1.2 These Terms apply to both:

- Mobile DJ Hire and associated entertainment services; and
- PA, speaker, lighting and associated equipment dry hire.

1.3 By making a booking and paying the required deposit, the customer ("the Client", "you" or "your") confirms that they have read, understood and accepted these Terms and agree to be bound by them.

1.4 The booking is for the services and/or equipment agreed at the time of booking, for the date, venue and times specified on the booking confirmation/invoice.

1.5 In the event of any discrepancy between an individual written booking agreement and these Terms, the specific written booking agreement shall take precedence only in respect of the matter expressly covered by it.

2. BOOKING CONFIRMATION AND DEPOSIT

2.1 A booking is considered confirmed once the required deposit has been received by ACM Elite Events.

2.2 Receipt of the deposit constitutes the Client's acceptance of these Terms & Conditions and confirmation of the agreement to provide the service agreed, on the agreed date and at the agreed times.

2.3 The deposit amount will be confirmed at the time of booking.

2.4 The deposit will be deducted from the total booking price and therefore forms part-payment towards the final balance.

2.5 Deposits are non-refundable, subject to any statutory rights that may apply.

2.6 Where the Client wishes to move a booking to an alternative date, ACM Elite Events may, at its discretion, transfer the deposit to the alternative date provided:

- the requested alternative date is available;
- the request is made before the original event date; and
- the Client accepts any reasonable difference in price resulting from the change.

2.7 A deposit does not guarantee availability of any alternative date until that date has been confirmed by ACM Elite Events.

3. PRICING AND PAYMENT

3.1 The total price for the agreed service or equipment hire will be confirmed to the Client at the time of booking.

3.2 The deposit will be deducted from the total price.

3.3 The remaining balance is payable no later than 28 days before the event or hire date.

3.4 Where the booking is made less than 28 days before the event date, the full outstanding amount may be required at the time of booking.

3.5 All invoices, booking confirmations and payment requests will be issued securely by email only to the email address provided by the Client.

3.6 The Client is responsible for ensuring that ACM Elite Events has the correct email address and for checking invoices and payment requests received from us.

3.7 Failure to pay the balance by the required due date may result in the booking being treated as cancelled by the Client, subject to the cancellation provisions in these Terms.

3.8 ACM Elite Events reserves the right not to provide services or release equipment where the required payment has not been received.

4. EVENT TIMES AND DURATION

4.1 The agreed start and finish times will be stated on the booking confirmation or invoice.

4.2 The Client is responsible for ensuring that the venue is accessible to ACM Elite Events at the agreed arrival/setup time.

4.3 The Client must ensure that the venue permits the agreed entertainment and that any necessary permissions, licences or venue approvals have been obtained.

4.4 Any delay caused by the Client, venue, guests, access restrictions, security requirements or circumstances outside our reasonable control will not automatically entitle the Client to a refund or extension of the agreed performance period.

4.5 Where practical and subject to availability, an extension to the agreed performance duration may be arranged with ACM Elite Events on the day of the event.

4.6 Any extension must be agreed with ACM Elite Events before the additional performance commences.

4.7 The additional cost of an extension must be agreed and paid in full before the extended performance begins.

4.8 ACM Elite Events is under no obligation to extend the performance beyond the originally agreed finishing time.

5. MOBILE DJ HIRE

5.1 Mobile DJ Hire may include, as agreed at the time of booking, DJ/MC services, professional sound/PA equipment, lighting, music playback and other associated entertainment equipment.

5.2 The precise equipment, services and facilities included in each booking will depend upon the package selected and will be confirmed to the Client.

5.3 Requests for particular music, playlists, genres or special announcements should be provided to ACM Elite Events in reasonable advance of the event.

5.4 While every reasonable effort will be made to accommodate music requests, ACM Elite Events cannot guarantee that every requested song will be played, particularly where requests are unsuitable for the event, unavailable, inappropriate, or conflict with the Client's agreed entertainment requirements.

5.5 ACM Elite Events reserves reasonable discretion over music selection and volume levels in order to maintain a suitable, safe and professional entertainment environment.

5.6 Where the venue imposes maximum sound levels or other restrictions, ACM Elite Events will comply with those requirements.

5.7 The Client is responsible for ensuring that the venue is suitable for the agreed DJ equipment and entertainment service, including adequate electrical supply, safe access and sufficient space.

6. VENUE, ACCESS AND ELECTRICITY

6.1 The Client must provide accurate information regarding the venue, access arrangements, parking, loading areas, stairs, lifts and any other relevant logistical requirements.

6.2 The Client must ensure that ACM Elite Events has reasonable and safe access to the venue for delivery, setup, operation and collection of equipment.

6.3 Where parking, loading or access charges apply, these should be disclosed before the booking and may be payable by the Client where agreed.

6.4 ACM Elite Events requires access to a safe and suitable electrical supply.

6.5 We will not knowingly connect equipment to an electrical supply that appears unsafe or unsuitable.

6.6 Where the venue requires PAT testing certificates, risk assessments, public liability insurance documentation or other information, the Client should notify ACM Elite Events before the event.

7. EQUIPMENT AND CARE

7.1 All equipment supplied by ACM Elite Events remains the property of ACM Elite Events unless expressly sold to the Client.

7.2 The Client and event guests must take reasonable care of all equipment supplied.

7.3 Equipment must not be moved, dismantled, altered, unplugged, reconfigured or interfered with by the Client, guests or other unauthorised persons unless expressly authorised by ACM Elite Events.

7.4 Guests or other persons found touching, interfering with, moving, disconnecting or otherwise tampering with ACM Elite Events equipment may result in the immediate termination of the entertainment service.

7.5 No person other than ACM Elite Events or an authorised technician may operate DJ, PA, lighting or associated equipment unless prior written permission has been given.

7.6 ACM Elite Events reserves the right to stop or modify the use of any equipment where continued operation presents a safety risk.

8. CLIENT AND GUEST CONDUCT

8.1 ACM Elite Events is committed to providing a professional, safe and enjoyable service.

8.2 The Client is responsible for the conduct of their guests and other persons attending the event.

8.3 Verbal abuse, threats, intimidation, harassment, discrimination or physical abuse towards ACM Elite Events, its staff, contractors or representatives will not be tolerated.

8.4 Any such behaviour may result in the immediate termination of the service without refund.

8.5 In serious circumstances, ACM Elite Events may leave the venue immediately and may contact the venue's security personnel or the police where appropriate.

8.6 The Client remains responsible for any damage caused to ACM Elite Events equipment by themselves, their guests or persons under their responsibility, subject to applicable law.

9. ALCOHOL AND LIQUIDS

9.1 The consumption of alcohol at an event does not give any person permission to interfere with ACM Elite Events equipment.

9.2 Drinks, bottles, glasses or other liquids must not be placed on, against, immediately next to or above any DJ, PA, lighting or electrical equipment.

9.3 Where liquid is spilled onto or near equipment, ACM Elite Events may immediately stop using the affected equipment where necessary for safety reasons.

9.4 Any damage caused by liquid, spills or inappropriate use may be charged to the responsible party, subject to applicable law.

10. CANCELLATION BY THE CLIENT

10.1 The Client may cancel their booking by notifying ACM Elite Events in writing by email.

10.2 Cancellation charges will be calculated according to the period remaining before the event date.

10.3 For the purposes of these cancellation charges, the "remaining balance" means the total booking price less the deposit already paid.

Cancellation 28 days or more before the event

10.4 Cancellation made 28 days or more before the event date will incur no additional cancellation charge, subject to the deposit provisions in these Terms.

10.5 The deposit remains non-refundable unless a statutory right requires otherwise.

Cancellation 28 to 14 days before the event

10.6 Cancellation made less than 28 days but 14 days or more before the event will incur a cancellation charge of 35% of the remaining balance.

Cancellation 14 to 3 days before the event

10.7 Cancellation made less than 14 days but 3 days or more before the event will incur a cancellation charge of 75% of the remaining balance.

Cancellation within 3 days of the event

10.8 Cancellation made less than 3 days before the event, including on the event date, will incur a cancellation charge of 100% of the remaining balance.

10.9 Where a cancellation charge exceeds the amount already paid, the outstanding cancellation charge will become immediately due.

10.10 Nothing in these cancellation provisions affects any cancellation or refund rights that cannot lawfully be excluded or restricted under applicable consumer legislation.

11. CANCELLATION OR NON-ATTENDANCE BY ACM ELITE EVENTS

11.1 ACM Elite Events will make every reasonable effort to attend and provide the services booked.

11.2 If ACM Elite Events is unable to attend an event due to circumstances within its reasonable control, we will make reasonable efforts to provide a like-for-like replacement service of comparable standard.

11.3 Where a suitable replacement cannot be arranged, ACM Elite Events will accept responsibility for compensating the Client up to 100% of the value of the booking, including the deposit paid, subject to applicable law.

11.4 Where a replacement service is offered, ACM Elite Events will communicate the relevant arrangements to the Client as soon as reasonably practicable.

11.5 Nothing in this clause limits any rights the Client may have under applicable consumer law.

12. FORCE MAJEURE

12.1 ACM Elite Events shall not be liable for failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control ("Force Majeure").

12.2 Force Majeure may include, but is not limited to:

- severe or dangerous weather conditions;
- flooding, fire or other natural disasters;
- serious illness, injury or incapacity;
- bereavement or other serious personal emergency;
- road closures or major transport disruption;
- vehicle breakdown where reasonable alternative arrangements cannot be made;
- electrical supply failure or unsafe electrical conditions;
- venue closure or loss of access;
- government restrictions or legal requirements;
- acts of terrorism or threats of terrorism;
- civil unrest, riots or disorder;
- war or threat of war;
- industrial disputes;
- epidemic or pandemic-related restrictions;
- failure of essential third-party services;
- actions or restrictions imposed by emergency services or authorities; or
- any other circumstance which could not reasonably have been anticipated or prevented.

12.3 ACM Elite Events will take reasonable steps to minimise the effects of a Force Majeure event and, where possible, will communicate with the Client promptly.

12.4 Where an alternative date or suitable alternative arrangement can reasonably be agreed, ACM Elite Events and the Client may agree to transfer the booking.

12.5 Where the services cannot reasonably be provided because of Force Majeure, the parties will seek to agree a fair and reasonable solution, taking into account the circumstances and any applicable statutory consumer rights.

12.6 Nothing in this clause excludes or restricts liability or rights which cannot legally be excluded or restricted.

13. PA & LIGHTING DRY HIRE

13.1 This section applies specifically to the hire of PA, speakers, amplifiers, microphones, lighting and other equipment supplied on a dry-hire basis, where ACM Elite Events does not provide a DJ or operator as part of the hire.

13.2 An inventory of the equipment supplied will be provided to the Hirer and will identify the items included within the hire.

13.3 The Hirer accepts responsibility for the equipment from the time of collection/delivery until it is returned to ACM Elite Events or otherwise collected by ACM Elite Events, as agreed.

13.4 The equipment must be used safely, responsibly and only for its intended purpose.

13.5 The Hirer must ensure that all persons using the equipment are competent to do so safely.

13.6 The Hirer must not:

- misuse the equipment;
- overload speakers or amplifiers;
- operate equipment in a manner likely to cause damage;
- modify or repair equipment;
- remove labels, serial numbers or identification marks;
- open or dismantle equipment;
- connect incompatible equipment;
- expose equipment to rain, excessive moisture or other damaging conditions; or
- allow unauthorised persons to interfere with the equipment.

13.7 No drinks, liquids, bottles, glasses or other beverages may be placed on, near or above any hired equipment at any time.

13.8 The Hirer must ensure that equipment is kept in a safe and secure environment during the hire period.

13.9 Equipment must not be left unattended in circumstances where it is reasonably likely to be stolen, damaged or misused.

14. DRY-HIRE COLLECTION, RETURN AND INSPECTION

14.1 Collection and return arrangements will be agreed with the Hirer before the hire period.

14.2 The Hirer must return all equipment by the agreed date and time.

14.3 Equipment will be inspected at the time of collection/return or following return, as appropriate.

14.4 The equipment is expected to be returned in the same general condition in which it was supplied, allowing for reasonable general wear and tear.

14.5 Any equipment that is missing, lost, stolen or damaged beyond reasonable wear and tear may be invoiced to the Hirer.

14.6 Charges for missing or damaged equipment will be based upon the reasonable current market value of the item, or the reasonable cost of repair or replacement, as applicable.

14.7 Where damage can reasonably be repaired, ACM Elite Events may charge the reasonable repair cost rather than the full replacement value.

14.8 The Hirer should notify ACM Elite Events immediately if equipment is damaged, lost, stolen or malfunctions during the hire period.

14.9 The Hirer must not attempt to repair damaged equipment unless expressly authorised by ACM Elite Events.

15. DRY-HIRE SAFETY

15.1 The Hirer is responsible for ensuring that equipment is installed and operated in a safe manner.

15.2 Speakers, stands, lighting stands and other elevated equipment must be placed on stable surfaces and secured appropriately.

15.3 Equipment must not be positioned where it creates an unreasonable trip, impact, fire or other safety hazard.

15.4 Electrical cables should be positioned and secured to minimise the risk of trips or damage.

15.5 Where equipment is used outdoors, the Hirer is responsible for providing suitable protection from rain, moisture and adverse weather.

15.6 ACM Elite Events may refuse to supply or may require the immediate cessation of use of equipment where the proposed use or environment presents an unacceptable safety risk.

16. LOSS, THEFT OR DAMAGE DURING DRY HIRE

16.1 The Hirer accepts responsibility for the security and reasonable care of equipment during the agreed hire period.

16.2 Where equipment is lost, stolen or damaged as a result of the Hirer's actions, negligence, misuse or failure to take reasonable care, the Hirer may be liable for the resulting reasonable repair or replacement costs.

16.3 The Hirer should maintain appropriate insurance where the value or circumstances of the hire make this advisable.

16.4 Nothing in these Terms makes the Hirer liable for damage caused solely by reasonable wear and tear or an inherent equipment fault not caused by misuse or negligence.

17. EQUIPMENT FAILURE

17.1 ACM Elite Events will make reasonable efforts to ensure that equipment supplied is in good working order.

17.2 In the event of an equipment failure, ACM Elite Events will, where reasonably possible, attempt to repair or replace the affected equipment.

17.3 The Client or Hirer should notify ACM Elite Events immediately of any equipment fault.

17.4 ACM Elite Events will not be responsible for failures caused by misuse, unauthorised alterations, unsuitable electrical supplies, third-party equipment, venue conditions or other circumstances outside our reasonable control.

18. MUSIC, COPYRIGHT AND LICENSING

18.1 ACM Elite Events will use music and other media in accordance with applicable licensing requirements.

18.2 The Client must not provide or require ACM Elite Events to use material that would knowingly infringe copyright, licensing restrictions or other applicable laws.

18.3 Where the venue is responsible for obtaining music, entertainment, public performance or other licences, the Client remains responsible for confirming that the venue has the necessary permissions.

19. PHOTOGRAPHY, VIDEO AND RECORDINGS

19.1 ACM Elite Events will not intentionally record or publish private event footage for promotional purposes without appropriate permission.

19.2 Where photographs or video are taken for promotional purposes, appropriate consent will be sought where required.

19.3 Clients who do not wish their event or identifiable images of themselves to be used for promotional purposes should notify ACM Elite Events in writing.

20. PERSONAL INFORMATION AND COMMUNICATION

20.1 ACM Elite Events will use Client information for legitimate business purposes, including processing bookings, communicating regarding events, issuing invoices and providing services.

20.2 Invoices and booking documentation will be sent securely by email.

20.3 The Client is responsible for providing accurate contact information and notifying ACM Elite Events of any changes.

20.4 Personal information will be handled in accordance with applicable UK data protection legislation.

21. LIABILITY

21.1 ACM Elite Events will provide its services with reasonable care and skill.

21.2 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded or limited.

21.3 ACM Elite Events is not responsible for losses arising from circumstances outside its reasonable control.

21.4 The Client is responsible for ensuring that the venue and event arrangements are suitable for the services being provided.

21.5 Nothing in these Terms affects the Client's statutory rights.

22. VENUE REQUIREMENTS

22.1 The Client must inform ACM Elite Events of any venue restrictions that may affect the service, including:

- sound limitations;
- curfews;
- access restrictions;
- loading restrictions;
- electrical restrictions;
- ceiling or height limitations;
- equipment restrictions;
- fire safety requirements; or
- restrictions on lighting, smoke/haze or other effects.

22.2 ACM Elite Events will comply with reasonable venue rules and safety requirements.

22.3 If a venue prevents or materially restricts the agreed service after arrival, ACM Elite Events will make reasonable efforts to provide an alternative service where practical.

22.4 Restrictions imposed by the venue which prevent the agreed service from being delivered do not automatically entitle the Client to a refund where ACM Elite Events was ready and able to perform the contracted service.

23. SMOKE, HAZE AND SPECIAL EFFECTS

23.1 Any smoke, haze, special effects or similar equipment will only be provided where specifically agreed as part of the booking.

23.2 Such effects may be subject to venue restrictions, fire alarm requirements and health and safety considerations.

23.3 ACM Elite Events reserves the right not to use an effect where its use would be unsafe or prohibited by the venue.

24. CHANGES TO BOOKINGS

24.1 Requests to change the date, venue, duration, equipment package or other material part of a booking should be made as soon as possible.

24.2 ACM Elite Events will consider requested changes subject to availability and operational requirements.

24.3 Changes are not confirmed until accepted by ACM Elite Events.

24.4 Changes that result in additional costs will be communicated to the Client before the change is confirmed.

25. THIRD-PARTY SUPPLIERS

25.1 Where ACM Elite Events recommends or uses a third-party supplier, venue, technician or contractor, their services may be subject to their own terms and conditions.

25.2 ACM Elite Events will use reasonable care when selecting any third-party supplier it directly engages.

25.3 ACM Elite Events is not responsible for the independent actions or failures of third parties where those matters are outside our reasonable control.

26. COMPLAINTS

26.1 Any complaint regarding the services should be raised with ACM Elite Events as soon as reasonably possible, preferably during the event where the issue can potentially be resolved immediately.

26.2 Complaints should subsequently be made in writing by email to acmeliteevents@gmail.com where a formal response is required.

26.3 ACM Elite Events will consider complaints fairly and will seek to resolve genuine issues reasonably and promptly.

27. STATUTORY RIGHTS

27.1 Nothing in these Terms is intended to remove, restrict or otherwise affect any statutory rights or protections available to consumers under applicable UK law.

27.2 Where a provision of these Terms is found to be unenforceable or unlawful, that provision shall be interpreted or modified to the minimum extent necessary, and the remaining provisions shall continue to apply.

28. GOVERNING LAW

28.1 These Terms and any contract between ACM Elite Events and the Client shall be governed by the laws of England and Wales.

28.2 Any dispute shall be subject to the jurisdiction of the courts of England and Wales, subject to any applicable consumer rights regarding jurisdiction.

29. ACCEPTANCE OF THESE TERMS

29.1 By paying the booking deposit, the Client confirms that:

- they have read and understood these Terms & Conditions;
- they accept these Terms & Conditions;
- they agree to the services and/or equipment specified in their booking;
- they agree to the agreed date and times;
- they understand the payment and cancellation provisions;
- they accept responsibility for complying with the relevant requirements relating to the venue and event; and
- where applicable, they accept responsibility for the safe and responsible use and return of dry-hire equipment.

29.2 Payment of the deposit constitutes acceptance of these Terms & Conditions and confirmation of the booking.
